The Adult Protection Act ensures that adults who are restricted in their decision-making ability due to mental illness or a comparable impairment, or who have lost it, have more independence, extensive preservation of their autonomy, and better options for structuring their representation.

Chosen guardianship of adults – the affected person has the opportunity to designate an adult representative themselves; the prerequisite is that the affected person can understand at least the basic implications of a power of attorney.

Statutory guardianship of adults – this allows a specific group of people (closest relatives) to represent the affected person but is subject to court control. Closest relatives are parents, grandparents, adult children, grown grandchildren, siblings, nieces/nephews, spouses, the registered partner, life partners who have lived together in the same household for three years, and persons named in a choice of guardianship of adults.
